The Road Haulage Association (RHA) is encouraging operators who have been affected by the truck manufacturing cartel to join their legal proceedings. There’s no cost for the claim, but to benefit, operators must opt in before 31 December 2024.

The claim has found operators that purchased or leased a new truck over 6 tonnes between 1997 and January 2014, or a used truck between 1997 and January 2015, may be entitled to compensation.

RHA

With over 18,000 operators already signed up, the RHA has been granted a Collective Proceedings Order by the Collective Proceedings Order (CPO) to commence legal proceedings after truck manufacturers were found to have broken competition rules.

The RHA and Backhouse Jones are bringing legal action after the European Commission fined European truck manufacturers (DAF, MAN, Iveco, Volvo/Renault, Daimler and Scania) over £3.4bn for serious violations of EU competition rules. The RHA say this resulted in operators paying too much for their trucks during the truck cartel period.

The RHA launched the claim for compensation in 2018 after truck manufacturers were found to have colluded on fixing prices and delaying the introduction of fuel-efficient emission technologies over a 14-year period.

To be eligible for the claim, the truck(s) must have been purchased or leased for road haulage operations. Trucks purchased to hire to other operators cannot be included. The RHA are urging operators to formally opt in to their claim,. You do not have to be an RHA member to join the claim.

Richard Smith, Managing Director or the Road Haulage Association, said: “The RHA continue to encourage any operators affected by the truck manufacturing cartel to opt into our legal proceedings before the 31 December deadline. We believe in fairness and transparency for everyone in our wonderful industry.

“This claim is the result of many years of legal work to ensure operators, at no extra cost, are compensated. If you believe you may be eligible, please do not hesitate to opt in or contact us before the deadline.”
